Client Contract – Terms and Agreement
By submitting your deposit with Party Bus Utah for said reservation time and date, of a vehicles provided by Party Bus Utah and or it’s affiliates. You are agreeing to the terms and conditions of this contract. Whether a contract is in-hand or not, verbal or written, this is a binding contract and you are accepting all responsibility for yourself and your guest while the vehicle is being rented on the agreed upon date and time with Party Bus Utah or all affiliates. The client accept responsibility for all guest activities while on board of the vehicle. This includes making sure that all clients guest abide to all state and federal laws while on the bus. This meaning all passengers are 21 years of age or older to consume or to have consumed alcohol. Party Bus Utah reserves the right to check identification to confirm all passengers age on or before entering such vehicle.
Party Bus Utah will strictly enforce State and Federal Laws and will maintain a zero tolerance compliance policy that no alcoholic beverages will be consumed or used by any person not of legal drinking age. All U.S. law enforcement agencies have absolute power to stop any motor vehicle for administrative searches. If contraband is aboard, even in negligible quantities without the driver’s knowledge, they can seize and forfeit this vehicle to a local government agency. All law enforcement agencies are expressively enforcing this policy. Therefore no person will bring contraband aboard vehicles that are owned and operated by Party Bus Utah and or it’s affiliates. Client responsibilities includes that all clients guest abide to Contract rule and Rules of Bus.
Party Bus Utah’s insurance is bound to each vehicles maximum load limits determining the number of people that are covered by the insurance carrier, of Party Bus Utah and or it’s affiliates. If that limit is exceeded the client assume all legal and insurance responsibilities for such guest.
The client takes all liabilities for self and guest for all injuries incurred while on Party Bus Utah’s vehicles or affiliates vehicles. The client can purchase additional insurance policies for client and guest @ www.libertymutual.com. They may also refer to credit card used for vehicle rental for possible coverage. Party Bus Utah or affiliates are not liabil for any and all injuries that occur during said rental time. Client and guest ride at there own risk of injury to self.
$150.00 credit card deposit is required to reserve your party bus. If the party bus rental is for a minor, under the age of 18, this agreement must be submitted by a parent or legal guardian over the age of 18 who will be the client for this contract.
Party Bus Utah requests that you call and reconfirm the pick-up times and address(es) 48 hours before service so your route will go smoothly.
Deposits and Billing.
The client authorizes the immediate charge of $150.00 deposit to his or her credit card. Cash deposit will also be accepted on some instances. Deposits are non-refundable under any circumstance. Client is responsible for the payment of the total amount of the contract, with cash, credit card or money order no later than the date of service before the trip begins. No personal or business checks will be accepted. The credit card holder gives authorization to use the credit card information over the phone/fax/internet. Driver must see state identification that matches credit card of the cardholder. If he or she cannot provide identification at the time of the pickup, Party Bus Utah will not start the job, as Party Bus Utah has no proof of the legal possession of the credit card. The client will still be fully responsible to pay the total amount of the contract as he or she failed to meet the above requirements.
No refunds are given for cancellations. A cancellation notice given 48 hours or more before service may allow a reservation to be rescheduled for a $50.00 administration fee. Phone contact must be made to confirm the cancellation and receive a confirmation number. Cancellations by Party Bus Utah for any reason will be credited for future reservations. Party Bus Utah reserves the right to subcontract another carrier if available to satisfy the contract or complete the remaining portion of a trip. If client cancels less than 48 hours before the scheduled rental date, Party Bus Utah is still authorized to collect the remaining balance of the contract in full. If client fails to arrive at designated pick up location 15 minutes past the scheduled pick-up time and does not inform office and/or driver during the 15 minute wait, the full amount of the contract will be charged. If client makes contact within that 15 minute wait period and states group is running late, driver will wait, and the rental time will continue to run as if client was on time.
Replacement Party Bus.
Party Bus Utah shall not be held responsible for late arrival caused by (but not limited to) acts of nature, traffic delays, breakdown, incorrect pickup and drop-off information, and any situation beyond its control. In the event of an emergency breakdown, Party Bus Utah will do everything possible to substitute or sub contract another party bus. In the event this does happen, client is still responsible for the contract amount, unless alternate transportation cannot be obtained. Since Party Bus Utah offers high-tech equipped vehicles, heat and the excessive use of all the power operated equipment will sometimes cause a temporary failure. Routine maintenance usually eliminates this from happening. Temporary failure will in no way interfere with the safety of the vehicle itself or the ability to get the client and guests to their destination. Therefore any outage will have no effect on continuing to pay for the contracted trip.
Party Bus Utah cannot guarantee the availability of overtime. Rental time starts at the arranged pick-up time at the first location and ends at the last drop-off location or when the last person leaves the party bus. Party Bus Utah gives clients a 10 minute grace period, after which client will be billed overtime in 1/4 hour increments at the rate of $40.00 per a quarter hour until the last person leaves the party bus. Charges are billed on the credit card used for deposit or payment. Revised 02/15 Driver Responsibility. The driver’s primary responsibility (in addition to transporting client and guests safely) is to safeguard the party bus. The driver is not allowed to ‘party’ with client or guests. The party bus will be locked when driver is away and is not responsible for guest belonging.
Judgment of the Driver.
The driver will determine if the behavior of client or guests is or are out of control, obnoxious, disrespectful, belligerent, unsafe, illegal, dangerous or irresponsible to lives and property, and can terminate the run on the spot and order all occupants out of the party bus. If there is only one person being unruly, he or she may be dropped off and authorities called. Driver may issue a warning before he takes this action. Client will not receive a refund and Party Bus Utah is not responsible for any further transportation.
Party Bus Utah is not held liable for delays due to weather, road, traffic, or mechanical conditions, driver’s illness or any other conditions beyond Party Bus Utah’s control. Party Bus Utah will not be responsible for lodging or food costs due to delays. If client is on a time schedule, then Party Bus Utah recommends reserving the party bus with enough time to make it to the destination. The driver will not ‘speed’ to an event or the next stop, he will drive as fast as the speed limits and safety allow.
General Party bus Care and Behavior.
There is NO smoking of any kind on Party Bus Utah’s vehicles; client will be fined $75.00 on first offense and dismissed from the party bus on second offense. Use the cup holders for drinks. Staying in your seat while the party bus is in motion will prevent falls and slips. No standing or jumping on seats. We agree that we will not hold the driver owner responsible for any accidents or injuries incurred through the improper use of the structural support poles. We have entered and ridden this bus at our own risk, and will not hold them responsible for our own actions while on the bus.Small ice chests allowed if kept on the floor. No food allowed. Do not turn up the sound system past 28; this saves the speakers from damage. Use the trash can provided for trash. Your Driver. Tips are not in the price of rental unless stated, and drivers are trying their best to make your time a fun and memorable one.
Before the party bus departs, client will walk through party bus with driver to ensure it is not damaged. Client is responsible for all guest damages. Damages will be assessed for repair, including down time, and charged to the client’s credit card used for deposit or payment. At Party Bus Utah’s discretion, client agrees to be fully liable for all charges that may incur. If there is excessive cleanup is required, a damage assessment will be determined once the bus has returned to the shop and has been thoroughly cleaned.
- $150.00 for extensive cleanup (spills, food etc.)
- $200.00 for exterior detailing and wax (due to sickness)
- $400.00 for interior detailing and disinfecting (due to sickness)
- $600.00 minimum per incident for damage to TV, video game console, stereo, upholstery, lights (LED, laser), video camera, poles or interior of bus
- $200.00 minimum per incident for lost or damaged media or video game controller
- $125 / $140 / $150 per hour party bus is unavailable to be rented due to damages caused by client or guests; down time will be determined by jobs turned down during repair period
Alcohol and Contraband.
No alcoholic beverages are served by Party Bus Utah or its employees. Party Bus Utah will not be liable for passengers who have consumed alcohol prior to, on board, or after the trip. No person under the legal drinking age shall consume alcohol onboard or around the party bus. If driver observes underage drinking, the party will end and no refunds will be given. Party Bus Utah refuses to transport anyone in possession of a weapon or illegal substance. Authorities may be contacted. If party bus vehicle is confiscated due to client’s or guests’ possession of such, client will be responsible for all legal fees and damages for down time (see ‘Damages’). If driver observes illegal activity, he can pull the party bus over and terminate the trip immediately. Client will not receive a refund and Party Bus Utah is not responsible for any further transportation.
Photos and Videos
Any and all photos or videos on, or with Party Bus Utah’s vehicles are property of Party Bus Utah. All individual’s photos or videos taken on or with Party Bus Utah’s vehicles are property of Party Bus Utah. Party Bus Utah reserves the right to use such images for promotional purposes. Any and all images of Party Bus Utah’s vehicles may only be used with expressed written consent from Party Bus Utah.
Party Bus Utah recommends all personal valuables be removed from the party bus when client and guests are not present. Party Bus Utah is not responsible for any lost, stolen, left behind, or damaged items.
I have read, understand, and will abide by the rules of this contract. with Party Bus Utah.
By submitting a deposit I agree to terms of this contract and Party Bus Utah’s bus rules. I agree to take full and all responsibility for all of my guest on Party Bus Utah’s vehicles.
